Obstetrician cleared of negligence in cerebral palsy case

An obstetrician and their hospital have been acquitted of negligence in delivering a baby with brain damage after the parents believed that they received poor care with monitoring, administration of medication and actual delivery of their newborn with a vacuum extractor. The parents believed that the delay in delivery and the method in which he was delivered caused his cerebral palsy from inadequate oxygen and direct brain injury. The hospital and doctor argued that cerebral palsy is still a relatively common occurrence in newborns due to genetic defects or unknown factors that cannot be prevented. The jury found in favour of the obstetrician and hospital.
