A husband brought a malpractice suit against a doctor who allegedly failed to diagnose his wife’s ovarian cyst for three years. She died as a result. Mediation resulted in a settlement for $725,000 on the conditions that a confidentiality clause was included. The judge refused to have the records sealed on the grounds that public money was being used to fund most of the settlement and thus the public had a right to know the details of what it was being spent on.
